Chronectia Terms of Service

These Terms of Service (hereinafter referred to as the “Terms”) set forth the conditions for the use of the “Chronectia” digital time capsule service (hereinafter referred to as the “Service”), provided by the Chronectia Administrator, Mr.84 (hereinafter referred to as the “Operator”).

All users of the Service (hereinafter referred to as “Users”) shall use the Service upon agreeing to these Terms.

Article 1 (Definitions)

The terms used in these Terms are defined as follows:

  • “Service” refers to the digital time capsule service provided by Chronectia.
  • “User” refers to any person who uses the Service.
  • “Capsule” refers to text, images, or other data saved by a User on the Service.
  • “Public Capsule” refers to a Capsule that becomes viewable by third parties after a specified date and time.
  • “Private Capsule” refers to a Capsule viewable only by those who possess the authentication credentials or a shared key.

Article 2 (Application of Terms)

These Terms apply to all matters concerning the use of the Service.

The Operator may modify these Terms as necessary. Modified Terms shall become effective upon being posted on the Service.

Article 3 (Registration)

Users shall complete registration in accordance with the methods stipulated by the Operator.

Users shall provide truthful and accurate information for registration and keep such information up to date at all times.

Users shall properly manage their own accounts and passwords and shall not lend, transfer, or share them with third parties.

Article 4 (Creation and Management of Capsules)

Users may use the Service to create Capsules intended for a specific future date and time.

Users bear full responsibility for the content of the Capsules they save.

The Operator does not guarantee the accuracy, legality, or utility of the Capsule content.

Article 5 (Prohibited Conduct)

  • Acts that violate laws or public order and morals.
  • Criminal acts or acts that promote criminal activity.
  • Acts that infringe upon the copyrights, trademark rights, portrait rights, privacy rights, or other rights of third parties.
  • Acts involving slander, defamation, discriminatory expressions, or other acts that cause disadvantage to third parties.
  • Acts that disclose third-party personal information without their consent.
  • Acts that transmit computer viruses or other harmful programs.
  • Acts that interfere with the operation of the Service.
  • Acts of unauthorized access or attempts thereof.
  • Acts of registering false information.
  • Any other acts deemed inappropriate by the Operator.

Article 6 (Responsibility for Content)

All responsibility for Capsules and other content saved, posted, or published by a User on the Service belongs solely to said User.

The Operator assumes no obligation to monitor the content saved or published by Users.

The Operator makes no warranties regarding the legality, accuracy, safety, or non-infringement of third-party rights concerning the content.

Should a dispute arise with a third party due to content saved or published by a User, the User shall resolve it at their own responsibility and expense, and the Operator shall bear no liability whatsoever.

Article 7 (Deletion of Content)

The Operator may delete or hide content without prior notice in the following cases:

  • If the Operator determines that these Terms have been violated.
  • If there is a risk of legal violation.
  • If a claim of rights infringement is received from a third party.
  • If the Operator deems it necessary for the operation of the Service.

Article 8 (Intellectual Property Rights)

Copyrights and other rights to Capsules posted by Users belong to said Users or the legitimate rights holders.

Rights concerning the name, design, program, and other content created by the Operator for the Service belong to the Operator.

Article 9 (Changes or Termination of Service)

The Operator may change, suspend, or terminate the Service without prior notice.

Article 10 (Disclaimer)

The Operator does not guarantee the completeness, accuracy, continuity, or safety of the Service.

The Operator shall not be held liable for any loss, damage, or inability to view saved Capsules due to server failures, communication failures, disasters, or other causes.

Article 11 (Suspension of Use and Account Deletion)

If the Operator determines that a User has violated or may violate these Terms, the Operator may suspend the User’s use or delete their account without prior notice.

Article 12 (Handling of Personal Information)

The handling of Users’ personal information shall be governed by the separately established Privacy Policy.

Article 13 (Governing Law and Jurisdiction)

These Terms shall be governed by the laws of Japan.

In the event of a dispute regarding the Service, the district court having jurisdiction over the Operator’s location shall be the exclusive agreed-upon court of first instance.
